Below, our selling property solicitor has discussed the steps involved in selling a house:

 

  1. Figure out where you are going to live after you sell your house.
  2. Put the house on the market. This can be done by engaging an Estate Agent for the purpose of advertising your property for sale. When a satisfactory offer has been received and the booking deposit paid the Estate Agent will forward a sale advice note to your solicitor. The sales advice note will detail the purchase price, the property addresses the address of the purchaser’s solicitor.
  3. Contact your solicitor. Local Solicitor will need to locate the title deeds so that you can sell the property. Where there is a mortgage on the property the title deeds will probably be held by your bank. Local solicitor will arrange to obtain the title deeds from the bank. The bank will usually charge an administration fee for releasing the title deeds.
  4. Get together the Local Property Tax details along with the Non-Principal Private Residence details and the household charge details.
  5. After accepting an offer, your solicitor can draft the contracts. Once Local solicitor has received the title deeds, we will investigate title and proceed to draft the contracts of sale. The contracts of sale are sent to the purchaser’s solicitor. Once the purchaser’s solicitor is satisfied with the contracts, they will arrange for the purchaser to sign and return them to Local solicitor together with the deposit. The deposit is usually 10% of the purchase price.
  6. Be prepared to have to deal with queries regarding the property. The purchaser’s solicitor will send a questionnaire to Local solicitor which will have to be completed by local solicitor. Once the purchaser’s solicitor is satisfied with the responses, they will forward a draft transfer document for approval.
  7. After the purchaser signs you will have to sign. Local solicitor will then prepare the closing documents and arrange a date for the purchaser’s solicitor to close the sale. Local solicitor will need you to attend to sign the closing documentation.
  8. Start organising removal. On the closing date the purchaser will be given the keys to the property this means you will need to have moved your belongings from the property before the closing date.
  9. The sale closes when the keys are handed over.
  10. Local solicitor will then have to pay off your mortgage. Local solicitor will write to the bank to obtain redemption figures. Local solicitor will arrange to discharge this mortgage from the purchase funds so that the purchaser will obtain a clear title. Local solicitor will arrange to discharge the outstanding mortgage from the proceeds of sale.
  11. You will then receive the balance of sale proceeds when the account is settled.
  12. Then you start the next chapter.
