Enduring Powers of Attorney Dublin
Local Solicitor provides services in relation to Enduring Powers of Attorney in Dublin. An Enduring Power of Attorney (EPA) legally appoints a named person (an attorney) to make personal financial and health care decisions on your behalf provided you lose mental capacity in the future.
When considering an Enduring Power of Attorney, you must decide on who will act for you in the future. That person will be your attorney. Your attorney can be your husband, wife, civil partner, relative or friend, or maybe a legal expert such as a solicitor. None of us knows what the future holds. An Enduring Powers of Attorney may never be needed or acted upon. However, once in place, if you do become mentally incapable in the years to come, your Attorney can immediately step in and start making decisions about things such as your finances, personal choices, where you live, your medical treatments and who you see.
An Enduring Power of Attorney is a method of legally appointing a named person that is trusted and relied on by you to make personal financial and health care decisions on your behalf, if you lose mental capacity in the future or if you do not want to make these decisions on your own.

If you do not make an Enduring Power of Attorney, the legal authority is not automatically granted to your loved ones to make personal care or financial decisions on your behalf. To get this authority, a friend or family member must apply to become a ‘Ward of Court.’ To become a Ward of Court involves a long, costly, and complicated process. Power may be granted to someone you would not have chosen. For these reasons, it makes sense to plan and make an Enduring Power of Attorney while you can do so. Not only is it less costly and giving you more control, but it is also much easier for everyone involved.
Creating an Enduring Power of Attorney, requires filling out the necessary forms. In these forms, you name your agreed Attorney and specify the range of powers you would like them to have. You can also make other stipulations, such as what should happen in the
event of your Attorney dying before you or becoming incapable of fulfilling the role of Enduring Powers of Attorney for any reason.
You are required to sign the document stating that you understand the implications of the Enduring Powers of Attorney. Local Solicitor and your doctor are also required to sign the document stating that you are mentally capable and have not been put under undue pressure to seek an Enduring Powers of Attorney.
At least two people must be notified that your Enduring Powers of Attorney has been created.
In the event of the loss of your mental faculties at any point in the future, your Enduring Powers of Attorney must be registered by your attorney at the High Court. Once registered your Attorney has the full legal authority to make personal care decisions for you.
