High Court Debt Collection

The High Court Debt Collection procedure is used for the recovery of debt over €75,000

The procedure involves the following steps:

• Gather all invoices relating to the debt
• Issue a letter of demand for payment.
• Issue a Summary Summons, (Local Solicitor will draft and get this document issued for you.)
• Allow 8 days for the debtor to enter an appearance
• If there is no response, complete an affidavit of debt which is then lodged with the court office along with additional papers which Local Solicitor will draft for you.
• Obtain judgement from the Court Office.
• Enforce the Judgment

Where the debtor files an appearance the following steps arise.

• Issue motion for liberty to enter final judgment, by way of notice of motion and grounding affidavit.
• The court services will assign a date for the motion to be heard
• The court will hear the motion.

Information which we require from you.

• Your name and address
• Name and address of the debtor
• Copy contract between you and the debtor (if any) or any other relevant correspondence
• Copy invoices sent to debtor
• Any response received from debtor in relation to the invoices raised (if any)
• Details of any payment made on foot of the invoice
• Amount of total debt due
